roger clemens’ attorney lacks understanding of grammar, law

Roger Clemens adamantly, vehemently, and whatever other adjectives can be used, denies that he has ever used steroids or … improper substances,” Clemens’ attorney, Rusty Hardin, said Thursday.”

“adamantly” and “vehemently” are, of course, not adjectives but adverbs as most 5th graders know. [check your understanding of adverbs with the google]

roger clemens’ attorney also makes the completely ridiculous point — one that would seem to turn the traditional american understanding of the seriousness of criminal prosecutions on its head — that this report coming to light is somehow worse than a criminal prosecution because (and i quote): “it’s not right to put somebody in a report with this kind of allegation and lack of proof, because there’s nothing he can do to combat it.”

if the court of public opinion is so horrible, why doesn’t our bill of rights contain a handful of protections for those accused in the court of public opinion like it does for those who are the subject of criminal actions? (maybe it’s because prosecutions are more serious than the public release of reliable information in reports):

  • Fourth Amendment – Protection from unreasonable search and seizure.

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

  • Fifth Amendment – Due process, double jeopardy, self-incrimination, private property.

    No person shall be held to answer for any capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

  • Sixth Amendment – Trial by jury and other rights of the accused.

    In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

  • Eighth Amendment – Prohibition of excessive bail, as well as cruel and unusual punishment.

    Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

unfortunately, our founders failed to consider mr. clemens’ plight: after twenty years of making his living by playing a game, after becoming famous, receiving accolades, and setting records, it is alleged in the court of public opinion that clemens has been cheating for nearly a decade. whatever will the poor millionaire do now?

    amen brother. and the best part is that in the subsequent hailstorm of all the reeling denials and affected, offended reactions–ESPECIALLY Clemens’–Andy Pettitte, Clemens’ best friend, steps up and says, “Yep, it’s true. I did it.” Awesome, and good on ya Andy. I think that the Mitchell Report provides enough evidence of it’s own to substantiate McNamee’s story (just read it, it’s ALL there), but now Pettitte just did too! You suck roger.
